Während jene Schrift insbesondere die Lehre von der Staatssouveränität kritisierte, bezweckt die jetzt vorliegende hauptsächlich, die positiven Grundlagen der ge genüberstehenden Lehre von der Rechtssouveränität auseinan derzusetzen und damit die moderne Staatsidee zum Ausdruck zu bringen. Auch diese Schrift wurde in der niederländischen Sprache, meiner Muttersprache, abgefasst, ist aber in eine den Auslän dern zugänglichere Sprache übersetzt worden, wofür ich auch diesmal (...) die deutsche Sprache wählte, weil die Ergebnisse spe ziell denjenigen der deutschen Staatswissenschaft gegenüber Stellung nehmen. Der Uebersetzung liegt das unter dem gleichen Titel in nie derländischer Sprache erschienene Werk, welches im Jahre 1915 veröffentlicht wurde, aber bereits vor dem Kriege druck in fertig war, zu grunde. Nachher veröffentlichte ich, gleichfalls niederländischer Sprache, eine Schrift: "Het Rechtsgezag" (1917), welche, anlässlich der hierzulande erschienenen Kriti ken, eine Verteidigung und Erläuterung der modernen Staats idee enthielt. Diese Schrift ist in der hier vorliegenden mitver arbeitet worden, demzufolge diese deutsche Ausgabe eine Zu sammenfassung der beiden obenerwähnten niederländischen Schriften bietet. H.K. cicero, der unbestrittene Meister der römischen Beredsamkeit in Theorie und Praxis, hat sich in mehreren Werken mit der Theorie der Rhetorik beschäftigt. Vom geplanten umfassenden Handbuch zur Rhetorik wurden nur zwei Bücher ausgearbeitet, die unter dem Titel "De inventione" überliefert sind. Unverkennbar ist die Nähe zu der anonymen, lange Zeit ebenso Cicero zugeschriebenen Schrift "Rhetorica ad Herennium". Gegen die zunehmende Verkümmerung des Rednerideals durch eine "Versachlichung" der rhetorischen Praxis kämpft Cicero in der kleinen Schrift "De optimo genere oratorum". Zwischen dem (...) Abfassen beider Schriften liegt ein Zeitraum von etwa 40 Jahren. "De inventione" gehört zu den Jugendwerken Ciceros und mit der "Rhetorica ad Herennium" zu den ältesten römischen Schriften zur Rhetorik überhaupt. (shrink)

Der Philosoph Wilhelm Dilthey nannte Ciceros "Der Staat" eines der größten Kunstwerke in Prosa. Cicero, der die höchsten Ämter im Staat innehatte und sich verzweifelt gegen den Untergang der Republik stemmte, verdichtet seine praktischen Erkenntnisse in diesem Werk zu einem Gefüge von Begriffen, das für das Leben jeder Gemeinschaft gültig ist. In Anlehnung an Platons "Politeia" legt Cicero in Form eines Dialoges die Vor- und Nachteile der unterschiedlichen Staatssysteme dar. Im Gegensatz zu Platon ist sein idealer Staat jedoch keine Fiktion, (...) sondern die römische Republik. Diese Ausgabe des berühmten ciceronischen Werkes, das Dilthey eines der größten Kunstwerke in Prosa nannte, will dem Leser die Bedeutung und Selbständigkeit des Staatsdenkens Ciceros zugänglich machen. In einer Zeit, die Fragen des gesellschaftlichen Zusammenlebens ein besonderes Interesse entgegenbringt, ist es nicht unwesentlich, sich ein Denken gegenwärtig zu halten, das menschliche Existenz ganz im Gemeinwesen des Staats begründet sieht.
